Mel spoke with Michael Ponterio, founding partner of Lipsitz, Ponterio and Comerford, LLC. There are many ways to get the compensation you are owed if you unfortunately have something like mesothelioma and bankruptcy trusts are just one of them.

Michael Ponterio says that about 40 years ago, one of the leading old manufacturers of asbestos, a company called Johns Manville, went bankrupt and set up a trust for people who were exposed to asbestos. He says that since Johns Manville there have been at least 40 to 50 other companies that are now bankrupt and they also formed these bankruptcy trusts.

Michael says that a person diagnosed with mesothelioma, in addition to a lawsuit against viable businesses, has the ability to file claims against old bankruptcy trusts.

Michael says that over the last 35 years, our firm has built up a database so that we can, if a client comes into our firm and says that I was just diagnosed with mesothelioma and that I worked at Bethlehem Steel; we can identify which companies are responsible for supplying asbestos to Bethlehem Steel and remain profitable and viable for legal action, and you can also bring claims against these bankrupt entities that supplied asbestos to Bethlehem Steel. So he says in that example that it’s important for a claimant to come see us as soon as possible so we can file that paperwork on their behalf.

Michael says that in order to qualify for the payment, you must establish not only the medical criteria for an asbestos diagnosis, but also exposure in a workplace where this company’s products were found.

Can families left behind make claims on behalf of a loved one who died of mesothelioma? Michael says that we try to get settlement money for a mesothelioma claimant while he is alive, and have been very successful in doing so. He says that sometimes these bankruptcy trusts take a little longer, so a state representative would be substituted if that person with mesothelioma passed away so that the family would still be entitled to compensation.

Michael tells Mel that this is what my founding partner John Lipsitz and I focus our livelihood on and our practice is helping people with asbestos disease, mesothelioma and lung cancer, and we compiled a database over 37 years and we have the knowledge and experience to help people. in Western New York make successful claims and be compensated as you should be.
